Contest Rules
This contest commences May 3, 2010 and ends on September 30, 2010 (the "Contest Close Date"). It is open only to residents of Ontario who are 18 years of age or older as of the date the contest commences.
Contest participants who register by filling out the registration form on the peakbusters.ca website or by mail (mail entries must be requested by calling 416-926-1907 x246) will receive one entry in each prize draw. NO PURCHASE NECESSARY. Participants can enter the contest without any purchase of goods or services by submitting a 200 word essay on "What Ontario can do to reduce peak electricity demand" to Angela Bischoff, OCAA, Suite 402, 625 Church St., ON M4Y 2G1 along with full name and mailing address. Additional entries will be recorded for electronic responses received in response to e-cards sent from the official PeakBusters site by the contest entrant. There will be one additional entry for one positive response.
Actions qualifying for entry in the prize draws must be substantially completed to the satisfaction of the Ontario Clean Air Alliance (OCAA) as of the prize draw date. For July and September prize draws, the deadline for substantially completing and recording actions will be 11:59 p.m. on the day preceding the official draw date. Draws will be held on July 5, 2010 and September 30, 2010. Snap draws will be held on any day for which an air quality alert has been issued by the Ontario Ministry of the Environment. Snap draws will take place at 5 p.m. on the first day of the alert and on each subsequent day until the alert is officially cancelled. If an alert is issued on a Saturday or Sunday, the snap draw will take place at 9 a.m. on the following Monday. The official information source for alerts is http://www.airqualityontario.com/.
OCAA reserves the right to request and receive reasonable proof that an action has been substantially completed before awarding prizes. (Examples of reasonable proof include sales receipts, photos, contracts, or EcoEnergy home assessment reports.) Prizes will be awarded at the sole discretion of OCAA.
Entrants whose primary residence is equipped with a central air conditioning system must have enrolled in an official utility peak demand reduction program (“peaksaver”) by the official prize draw date to qualify for the prize draw. Entrants whose primary residence is not equipped with central air conditioning are eligible for the Non-air conditioning equipped draw category (“No air conditioning, no problem – you can still win”). Entrants whose primary residence is a multi-residential building may enter the non air conditioning equipped draw category.
Central air conditioning for the purposes of this contest is a system designed to cool the entire home or other residential structure and that is qualified for enrollment in a demand response program such as peaksaver.
All prize draws will be held at the offices of the Ontario Clean Air Alliance, Suite 402, 625 Church St., Toronto, ON M4Y 2G1 between 9 a.m. and 5 p.m. on the prize draw date.
Selected entrants will be sent a mailed notification within two working days of a prize draw and may also receive telephone notification.
Selected entrants will have six months from the draw date to claim prizes, but must respond to the prize notification within 30 days of the draw date. If the selected entrant cannot be contacted within 30 days, the prize will be redrawn.
Odds of winning depend on the number of contest entrants in each category (homes with central air conditioning and homes without central air conditioning).
Each contest participant is eligible to win only one prize.
Mention of a product or service on this website does not represent an endorsement by the OCAA.
Employees and contractors of the OCAA and members of their respective immediate families (defined as parents, children, siblings and spouse) or households, are not eligible to enter.
By entering, participants agree to be bound by the contest rules and the decisions of OCAA and to comply with all federal, provincial, and municipal laws. By accepting a prize, the winner agrees to accept all conditions, restrictions, requirements and/or regulations required by OCAA in connection with the prize, and to accept delivery of the prize based on availability and as awarded. No substitution for, or transfer of, or cash equivalents for, prizes will be allowed, save for the OCAA’s right to substitute a prize of equal or greater value in OCAA’s sole discretion.
In order to claim a prize and be declared the winner, the selected entrant will be required to:
(a) correctly answer, without electronic, mechanical or other assistance, a time-limited mathematical skill-testing question to be administered by mail or phone at a mutually convenient time; and (b) sign a declaration and release form to (i) confirm compliance with the contest rules; (ii) accept the prize as awarded, without substitution; (iii) release the OCAA and an parties co-sponsoring the contest from any liability, as described more fully below; and (iv) consent to the use of his or her name, address (city and province) and/or photograph or image, as described more fully below.
Failure by any selected entrant to complete, sign and return any of the above documents within 30 days after notification is sent to the address on the selected entrant’s entry, or the return of prize documents as undeliverable, may result in forfeiture of the prize and selection of an alternate winner in OCAA’s sole discretion. Communication regarding the contest will be entered into only with selected entrants.
This contest is subject to all applicable federal, provincial, and municipal laws. No responsibility will be taken for lost, late, damaged, or misdirected entries.
Unless otherwise prohibited by law, by entering the contest or accepting a prize, the winner consents to the use of his or her name, photograph, likeness, biographical information and address (city and province) in publicity and advertising relating to this contest and similar promotions carried out by the OCAA, in any form of media, including the Internet, without compensation, worldwide in perpetuity. By entering or accepting a prize, participants agree to release and hold harmless OCAA, and any parties co-sponsoring this contest (including Ontario Power Authority, PowerStream Inc., Veridian Inc., enerShift, Rodan Energy, Newmarket Hydro, Horizon Utilities, Brantford Power, Enbridge Gas Distribution Inc., Toronto Hydro Inc. and Brant County Power Inc.) and their respective directors, officers, employees and agents, from any claim, loss, expense or other liability, including liability for personal injury, arising from participation in the contest or the awarding, acceptance, use or misuse of any prize.
OCAA reserves the right to terminate or amend this contest at any time and in any way, without prior notice. Furthermore, if, as a result of an error relating to the entry process, drawing or any other aspect of the contest, there are more potential winners of prizes than contemplated in the contest rules, there will be a random draw amongst all eligible prize claimants after the Contest Closing Date to award the prize. OCAA shall not be held responsible for any problems, errors or negligence that may arise or occur in connection with the contest including but not limited to any damage to an entrant’s computer equipment, system, software or any combination thereof, as a result of the entrant’s participation in this contest.
OCAA shall not be liable to the confirmed winner of any prize for any guarantee, warranty, condition or representation, express or implied, relating to the prize, including, without limitation, its quality, condition or fitness for a particular purpose.
By entering the contest and/or claiming a prize, participants consent to OCAA’s collection, use and disclosure of personal information to any third party with whom OCAA shares such information for the purposes of consumer research and marketing and administering the contest.
